FoodDigger is an online community for food enthusiasts that helps people share information about restaurants, identify people with similar tastes, vote up people they trust, maintain favorites, try lists, and more. Our Members write reviews about restaurants or other food related establishments that are posted to the FoodDigger site where they can be accessed and read by other FoodDigger users. These reviews are aggregated and collectively displayed to you on the FoodDigger site as an overall rating, the “FD Score”, for each restaurant. FoodDigger Members will each have their own Member page that contains their reviews, try lists, and certain personal information such as, user profile photo, city of residence, and the unique user name (the “Member Name”) chosen by them upon registration. The Member page enables Members to, among other things, track the reviews they have posted and the reviewers they like, and to personalize their reviews by providing some information about themselves.

1.1 Information you provide - When you sign up for a FoodDigger account, we collect personal information such as name, email address, zip code, birthdate, etc.. FoodDigger also collects user ratings and restaurant reviews, user submitted photos, and any other comments or content that you may submit in the course of your use of the site. We collect this information in order to provide you with FoodDigger services, to enable you to evaluate particular reviews, and to provide you with personalized features. We may combine the information you submit with information from other users, from other FoodDigger services, or from third parties in order to provide you with a better experience or to improve the quality of our services.

1.2 Cookies - We may send cookies, which are small packets of text, from our servers to users’ web browsers. These cookies will then be sent back to us each time it accesses our server. Cookies are used for tracking, authenticating, and maintaining specific information about users, such as site preferences, login ID, and maintenance of the logged in state. Please be aware that there may be advertisements on FoodDigger that are served by third parties who utilize their own cookies to track the performance of these advertisements. FoodDigger does not control the use of cookies by advertisers or any information advertisers may gather from their use of cookies.

1.3 Server Log Information- Information is automatically collected by our server logs regarding server activity. Our server logs will log your browser-type related information, IP address, requested URL, referring URL, date and timestamp of your web request, session duration, pages viewed, and one or more cookies that may uniquely identify your browser.

1.4 User communications – When you send email or other communications to FoodDigger or to other users from the FoodDigger site, we may retain those communications in order to process your inquiries, respond to our requests or improve our services.

2.1 FoodDigger is a service that enables the sharing of information. Therefore, all information included in your reviews, your Member page (including, without limitation, your profile photo, tagline, try list, and Member Name), and any other content submitted by you on this site may be shared with other users on the FoodDigger site. We do not display your email address on the FoodDigger site but allow users to associate your email address with your account and profile through our Member search directory.

2.2 In addition, we use your information to:

a. Provide our products and services to users of the FoodDigger site, including the display of customized content and advertising;

b. Conduct audits, research and analysis of (i) our services, (ii) user behavior and characteristics, and (iii) the technical functionality of our network, in order to maintain, protect and improve our services; and

c. Develop new services.

2.3 FoodDigger processes personal information on our servers in the United States of America and may also process such information in other countries.

3.1 FoodDigger only shares personal information with other companies or individuals outside of FoodDigger in the following limited circumstances:

a. As stated in our Terms of Service, we may license to third parties your reviews, Member page information, and any other content submitted by you on the FoodDigger site. In addition, we reserve the right, but will not be obligated to, include your Member Name, city and state, in connection with any information that may be licensed to third parties. For example, we may make FoodDigger reviews available on a third party’s services. In which case your reviews, any photos submitted in connection with the reviews, and any personally identifiable information you have included in your reviews may be transferred to such third party and displayed in connection with such party's publication of your reviews, along with your Member Name, city and state.

b. We have your consent.

c. We provide such information to trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this policy and any other appropriate confidentiality and security measures.

d. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (i) satisfy any applicable law, regulation, legal process or enforceable governmental request, (ii) enforce the FoodDigger Terms of Service, including investigation of potential violations thereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, or (iv) protect against imminent harm to the rights, property or safety of FoodDigger, its users, or the public as required or permitted by law.

3.2 We may also disclose information to third parties about our users that does not identify the user’s specific identity. For example, we may disclose aggregated, non-personally identifiable data of users, such as total number of searches for a particular term or total users who clicked on a given advertisement. Furthermore, we may share your personal information including your contact information with affiliates, partners, and other third parties for the purpose of presenting offers for products or services, as well as for sending other communications to you.

3.3 We reserve the right to transfer your personal information in the event of a transfer of ownership of FoodDigger, such as an acquisition by or merger with another company. In such an event, FoodDigger will notify you before information about you is transferred and becomes subject to a different privacy policy.

This privacy policy applies solely to users of the FoodDigger site. We may link to other websites that are not owned or controlled by FoodDigger. We are not responsible for these other websites and encourage users to read the privacy policy of these other sites.

5.1 FoodDigger is a publicly viewable forum that is intended to enable the sharing of information on restaurants and other food related services to the general public. Therefore, please do not post any information on the FoodDigger site that you wish to maintain private. If you choose to disclose personally identifiable information (e.g., name, e-mail address, phone number) via reviews, messages, forums, postings, or in other areas of the FoodDigger site, that information, along with any substantive information disclosed by you, can be collected and used by third parties and may result in unsolicited messages to you. Such activities are beyond the control of FoodDigger.

5.2 We may require a limited amount of personal information be displayed regarding each user. This limited information is used to identify reviewers and provide some background on reviewers in order to aid in evaluating reviews. For example, we display your Member Name, which is a name chosen by you upon registration. We also use your zip code to display the City of your residence. You may choose not to submit certain personal information to FoodDigger, in which case FoodDigger may not be able to provide certain services to you.

5.3 Generally, access and control of your personal information is available by using the editing tools on your account. Otherwise, upon your request, we will make good faith efforts to provide you with access to your personal information. In such case, we will either correct this data if it is inaccurate or delete such data, so long as we are not required to retain such data for legal or other legitimate business purposes. We may choose not to remove or edit your personal information in the event that doing so would be impracticable, costly, require disproportionate technical effort, or affect the data or privacy of others. Also, please be aware that it may be impossible to remove your account without some residual information being retained by FoodDigger. FoodDigger does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for FoodDigger or send any information about yourself to us, including your name, address, or email address. No one under age 13 may provide any personal information to or on FoodDigger. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. 7.1 We take the security of your account seriously. Your FoodDigger account is password-protected. We limit access to your account information to those employees, contractors, agents and service providers who need access to perform their job function (such as our customer service personnel).
